Terms of Service
Last updated: October 2026
Scope
These terms apply to all packages, proposals, projects and services by Mediaway (Desaever Group, VAT BE1019.705.075). For packages bought online, the package description on our website defines the scope; for custom projects, the written proposal you accept does.
Prices & payment
Prices exclude VAT unless stated. VAT is added at checkout (reverse charge for EU businesses with a valid VAT number). Package prices on our website are indicative starting prices. Website packages start after a deposit of 50% of the starting price. After the kick-off we confirm the final price in writing; work beyond the package is only added with your approval. The balance (final price minus the deposit) is due at launch, before the site goes live. Hosting & care plans are billed monthly or yearly in advance and can be cancelled before the next billing period. Invoices are payable within 14 days.
Right of withdrawal (consumers)
If you buy as a consumer (not for your business), you may withdraw from the contract within 14 days without giving a reason by emailing hello@mediaway.net. If you ask us to start work within those 14 days, you pay a proportionate amount for the work already done when you withdraw. The right of withdrawal ends once the service has been fully performed with your consent.
Business customers have no statutory withdrawal right; cancellations are handled as agreed, and work already carried out is invoiced.
Revisions and changes
Each package includes the stated number of revision rounds. Work outside the package or agreed scope is quoted separately and only starts after your approval.
Ownership
After full payment you own the delivered website, design files and assets. Third-party components (fonts, stock images, plugins) stay under their own licences.
Your input
You provide content, feedback and approvals in reasonable time and confirm you have the rights to material you supply. Delays in input can shift the delivery date.
Liability
Our liability is limited to the amount paid for the relevant service. We are not liable for indirect damage, loss of revenue or problems caused by third-party services. This does not limit rights you have as a consumer under mandatory law.
Law
Belgian law applies. Disputes go to the competent courts of Belgium. Consumers can also use the EU Online Dispute Resolution platform.
